Section 12(d) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1760(d)) is amended—
(1) by striking the subsection designation and all that follows through Act— in the matter preceding paragraph (1) and inserting the following:
(d) Definitions. In this Act:
(2) by striking paragraph (2) and inserting the following:
(2) Commodity only school. The term commodity only school means a school that—
(A) does not participate in the school lunch program under this Act; but
(B) receives commodities made available by the Secretary for use by the school in a nonprofit lunch program.
(3) in paragraph (3), by striking U.S.C and inserting U.S.C.;
(4) in paragraph (5)—
(A) by striking the paragraph designation and all that follows through not limited to, in the first sentence and inserting the following:
(5) School
(A) In general. The term school means—
(i) any public or nonprofit private school of high school grade or under; and
(ii) any public or licensed nonprofit private residential child care institution (including
; and
(B) in clause (ii) of subparagraph (A) (as so designated), by striking For purposes of this paragraph and inserting the following:
(B) Associated definition. For purposes of schools and institutions under subparagraph (A)
(5) in paragraph (6), by striking School and inserting school; and
(6) in each of paragraphs (6) through (9)—
(A) by inserting The term after the paragraph designation; and
(B) by inserting a paragraph heading, the text of which comprises the term defined in the paragraph.
