(a) Prohibition. Notwithstanding any other provision of law, without an express provision of Federal statutory law, no Executive action, including any Executive order, presidential memorandum, or directive of the Office of Management and Budget, may—

(1) abolish, eliminate, defund (or otherwise reduce funding for), or reduce below legally mandated minimum staffing levels (including as provided in this title) any Federal office, agency, or program established by a provision of Federal statutory law, or otherwise described in section 11002;

(2) direct a Federal agency to remove sociodemographic data from any Federal survey, dataset, or public health surveillance system relating to characteristics protected under Federal law; or

(3) direct any Federal agency to terminate, suspend, or cease enforcement of any provision of the Civil Rights Act of 1964 (42 U.S.C. 2000a et seq), the Fair Housing Act (42 U.S.C. 3601 et seq.), the Americans with Disabilities Act of 1990 (42 U.S.C. 12101 et seq.), the Age Discrimination in Employment Act of 1967 (29 U.S.C. 621 et seq.), the Voting Rights Act of 1965 (52 U.S.C. 10301 et seq.), or any other Federal civil rights statute.

(b) Congressional notification requirement. Not later than 5 days after the issuance of any Executive order that the President contends affects Federal offices or programs relating to health equity, civil rights, anti-discrimination, or sociodemographic data collection, the Director of the Office of Management and Budget shall submit a written notification to the relevant congressional oversight committees describing the actions directed by such order and their projected effects on the affected offices and programs.

(c) Private right of action. Any person aggrieved by a violation of subsection (a) may bring a civil action in an appropriate Federal district court for declaratory and injunctive relief. A court in such an action may award reasonable attorneys’ fees to prevailing plaintiffs.
